Customer Acknowledgment.
Customer hereby acknowledges that Customer has read and fully understands the following terms and conditions which shall be deemed a binding part of Customer’s contract with My Curly Stylist for haircuts, coloring, and styling services. Customer further acknowledges that these terms and conditions are a material inducement for My Curly Stylist’s agreement to enter into a contract with Customer for said services. Customer acknowledges that the services covered by this agreement include, but are not limited to, haircuts, coloring, and styling. The Customer agrees to the terms set forth as a condition of receiving these services.
Complaints/Guarantee
You agree to inform My Curly Stylist within 48 hours if you are dissatisfied for any reason with the service provided. Valid complaints may include dissatisfaction with the style, color, or quality of the service. You agree to choose one of the next three available appointments for a free touch-up, provided all outstanding balances are cleared. Outstanding balances include any unpaid fees for previous services or appointments.
Coupons/ Offers/ Discounts
All coupons must be submitted during the scheduling of an appointment online or with a My Curly Stylist scheduler. Each coupon or offer is limited to one per customer per visit. Referral discount codes are applicable only to new customers referred by an existing customer and can be used once per household. Coupons and offers cannot be combined with any other discounts or promotions.
Online Promotions and giveaways
All online promotions and giveaways are limited to My Curly Stylist’s service areas only. These promotions are not sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, TikTok, or any other social media platforms. Winners will be selected based on the criteria outlined in the promotional post and announced via our social media channels. Soliciting Policy
You agree not to solicit for hire any staff member introduced to you by My Curly Stylist for any beauty-related services outside of My Curly Stylist. If found soliciting, you will be flagged in our system and barred from scheduling future services with us. My Curly Stylist reserves the right to seek legal remedies, including but not limited to, injunctions or monetary damages for any violation of this policy.
Mobile Terms of Service
The My Curly Stylist mobile message service (the “Service”) is operated by My Curly Stylist (“My Curly Stylist”, “MCS”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to My Curly Stylist’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of My Curly Stylist through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with My Curly Stylist. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to My Curly Stylist or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other My Curly Stylist mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt-out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any shortcode or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Cancellation, No Show and Late Arrivals Policy
We work hard to maximize our time so we can get everyone in a timely manner. Sometimes kids get sick, your car breaks down, dinosaurs come back to life and chase you down the street. We understand, life happens, and that’s okay. We show up everyday to get your curls looking bouncier than ever. So when you cancel with less than 48 hrs notice, it makes it hard to fill your spot that could be given to someone else who wanted to come in.
So… please give us the courtesy of a 48 hours notice and we’ll be happy to see you at your next appointment. With less than 48 hours notice, you will be charged in accordance with the cancellation policy (posted below)
Cancellations
Your appointment is very important to us. That time is reserved just for you with the expectation that you will show up to your appointment. We understand, things come up and you need to change your schedule around. We require a 48 hours advance notice to cancel appointments with no charge.
For less than 48 hours notice you will be charged a fee of 50% of your requested service.
No Shows
If you do not show up to your appointment, it means we cannot offer your appointment time to someone else who is on the wait-list. That means we end up spending our time sitting, waiting and wondering where you are. We will do our best to contact you through a phone call, text message and email.
If you no show you will be charged 100% of your scheduled service. This will need to be paid before you can schedule your next service.
Late Arrival
We try to maximize our schedule so we can get you in and out on time. When you are late, it puts us behind and that affects all appointments after you and takes time away from our families. If you are running behind please contact us and let me know. If you are more than 15 minutes late we will not have enough time to give you the amazing service you requested, and will have to reschedule you.
The cost for this will be the equivalent of a “Late Cancellation” fee which is of 50% of the requested service.
When you book your appointment and enter your credit card information into the online scheduling system, you are agreeing to this policy.
CC information & Payment
Our booking system asks for your credit card information to HOLD your appointment spot. Your card will not be charged when you book your appointment. For No-shows or Late Cancellations, we WILL NOT charge your card without giving you advanced notice.
Payment is due at the end of your service. We accept Cards and Cash.
***These fees can be waived at My Curly Stylist’s sole discretion***
Limitation of Liability.
My Curly Stylist’s entire liability and your sole and exclusive remedy for any and all losses and damages for any cause of action arising out of services provided to you by My Curly Stylist shall be limited, at My Curly Stylist’s option and in My Curly Stylist’s sole discretion, to a refund of payment(s) for the service(s) at issue as determined by My Curly Stylist in its sole discretion. IN NO EVENT SHALL MY CURLY STYLIST BE LIABLE FOR ANY LOSS, LIABILITY, DAMAGE OR EXPENSE IN AN AMOUNT IN EXCESS OF YOUR ANNUAL TOTAL INVESTMENT, CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO CLAIM ANY ADDITIONAL DAMAGES, INCLUDING BUT NOT LIMITED TO: ANY LOSS OF USE OR PROFITS, LOSS OF BUSINESS, LOSS OF BUSINESS REPUTATION, EXPENSES OR COSTS ARISING FROM OR ALLEGED TO ARISE FROM BUSINESS INTERRUPTION, DAMAGE TO REAL OR PERSONAL PROPERTY, AND FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR SPECIAL DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, TORT, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY OR OTHER BREACH OF DUTY BY MY CURLY STYLIST.
Governing Law – Venue.
All disputes between you and My Curly Stylist shall be governed by Utah state law and resolved exclusively in the state or federal courts located in Utah County, Utah.
Class Action Waiver.
TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO MAKE A CLAIM FOR DAMAGES AS A CLASS MEMBER IN ANY CLASS ACTION OR AS PART OF A PLAINTIFF GROUP. You and My Curly Stylist agree that each may bring claims against the other only in your or its individual capacity and not as a member of any class or as part of a class or representative action. Unless you and My Curly Stylist agree, a court may not consolidate any dispute between us with disputes involving other people OR PARTIES.
